Terms and Conditions (AGB) – Authistical Art

1. Scope and Contractual Partner

These Terms and Conditions apply to all sales of artworks, limited editions, and prints made through the website authistical.art or by direct correspondence with the artist.

2. Offer and Product Descriptions

All artworks and prints shown on this website are unique or limited-edition pieces created by the artist. Images and descriptions are as accurate as possible; minor variations in colour, texture, or framing may occur. The artist may make technical or artistic adjustments prior to dispatch provided the overall character of the work is not affected.

3. Prices and Value Added Tax (VAT)

All prices are stated in euros (€) and include the applicable VAT under German law. Original artworks generally carry a reduced VAT rate of 7%; prints and reproductions carry 19%. Shipping costs, if any, are shown before checkout or agreed individually.

4. Payment Terms

Payment is due upon order confirmation unless otherwise agreed. Accepted methods are those shown at checkout or on the invoice (e.g., PayPal, Stripe, bank transfer, card). Orders are processed once payment is received in full.

5. Delivery and Shipping

Artworks are shipped securely, insured, and professionally packaged. Delivery times and costs vary by destination and size. The customer is responsible for accurate delivery information. For international deliveries, import duties, customs fees, or local taxes (if applicable) are borne by the buyer unless expressly stated otherwise.

6. Right of Withdrawal (Widerrufsrecht)

EU customers may withdraw from the purchase within 14 days of receipt without giving reasons. To exercise this right, notify the artist in writing by email. Custom or commissioned works are excluded from withdrawal once production has begun. Returns must be shipped in original condition and packaging; the buyer bears return costs unless otherwise agreed.

7. Retention of Title

All artworks remain the property of the artist until payment has been received in full.

8. Copyright and Usage Rights

All copyrights remain with the artist. No reproduction, digital duplication, or commercial use is permitted without written consent. The purchase of a physical artwork does not include reproduction or commercial usage rights.

9. Resale Royalty Clause

The artist retains a continuing interest in the work. In the event of resale, 10% of the resale price is to be paid directly to the artist, Bogdan Jensen, within 30 days of the transaction. Details and payment information: authistical.art/royalty. This clause applies to all future resales, unless superseded by mandatory local law providing higher royalties.

10. Liability

The artist is not liable for minor deviations in colour or form due to display differences or natural materials. Damage claims are limited to foreseeable losses caused by intent or gross negligence, except in cases of injury to life, body, or health.

11. Governing Law and Dispute Resolution

These Terms are governed by German law, excluding the UN CISG. The European Commission’s ODR platform: ec.europa.eu/consumers/odr. The artist is not obliged nor willing to participate in consumer arbitration board proceedings.
